1. Agreement to Terms

By accessing or using the ZonePulse website (accessible at zonepulsespark.com), web application, or services provided by ZonePulse LLC ("Company", "We", "Us", or "Our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not access or use the Service.

STRICT GEOGRAPHICAL LIMITATION: ZonePulse is strictly a USA-only software. The Service is intended, hosted, and operated solely for users located within the United States of America ("USA"). You must be at least 18 years of age and reside in the USA to purchase access passes or use the Service.

2. Description of Service & Disclaimers

ZonePulse provides independent driver zone analytics, location metrics, and informational intelligence tools designed to assist independent gig workers. You acknowledge and agree that:

  • All predictions, driver density metrics, active driver estimations, and location models are generated via algorithmic simulation and estimation tools for informational purposes only.
  • ZonePulse does not guarantee specific earnings, order volumes, or delivery assignments.
  • The Service does not utilize, access, or bypass private internal driver tracking APIs or automated bots.

3. Non-Affiliation Notice

ZonePulse LLC is an independent software provider. ZonePulse is NOT affiliated with, authorized, maintained, sponsored, endorsed, or in any way officially connected with Walmart Inc., Spark Driver, or any of their parent companies, subsidiaries, or affiliates.

4. Access Passes, Pricing & Billing

We offer various access plans, including one-time short-term passes (e.g., 30-Minute Access Pass and 24-Hour Pass), recurring subscription options (e.g., 7-Day Access and Monthly Subscription), and the $79.99 Lifetime Pro Suite Plan (Lifetime Pass). All payments are securely processed through our third-party payment gateway (Stripe).

  • 30-Minute Access Pass: The $2.99 pass provides instant on-screen delivery and direct pass access; no email access code is sent.
  • One-Time Purchases: Passes designated as "One-Time Purchase" or "Pass" (such as the 24-Hour Pass) represent a non-recurring single charge granting access for the specified hourly duration starting from activation.
  • Lifetime Pro Suite Plan: The $79.99 Lifetime Pass provides lifetime access. Access for this plan and all code-based access products is delivered via an access code sent to the email address provided at checkout.
  • Subscriptions: Plans designated as subscriptions will automatically renew at the specified frequency (e.g., weekly or monthly) unless canceled prior to the renewal date via your account settings or support request.

5. Refund Policy

We stand by our product 100% and are confident in the value it provides. However, we understand that each situation is different. If you are not completely satisfied with your purchase, please contact us within 3 days of your order. Our team will carefully review your case, and if it meets the eligibility criteria outlined in our refund policy, you may qualify for a refund. You can continue to access the results as our way of saying thank you for giving us a try.

6. User Conduct & Security

You agree not to misuse the Service, reverse engineer the application, attempt unauthorized access to servers or access code infrastructure, or share assigned access credentials with unauthorized third parties. ZonePulse reserves the right, in its sole and absolute discretion, to immediately suspend, deactivate, revoke access codes, or permanently terminate your access to the Service—without prior notice and without refund or liability—if you breach any provision of these Terms, share access codes/credentials, or engage in unauthorized scraping/misuse.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ZonePulse LLC, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to, use of, or inability to use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.
